Welcome to Chipin, a product of Benevolent Impact LLC. These Terms and Conditions (“Terms”) govern your use of our contests, services, websites, and integrations with third-party golf platforms (collectively, the “Services”). By registering for or using any part of the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

To use the Services, you must:

Be at least 18 years old

Create and maintain only one user account

Reside in a jurisdiction that permits participation in skill-based contests

Participation is not permitted in states or regions where skill-based contests are restricted or illegal. Users are responsible for complying with their local laws. We reserve the right to deny or terminate access based on your location.

2. Account Registration

Creating an account is required to enter contests or make donations. You agree to provide accurate information and to keep your login credentials secure. Creating multiple accounts or using the Services in a way that circumvents contest limits is prohibited.

3. Services and Contests

Chipin offers golf-themed skill-based competitions such as Closest to the Pin, which may be accessed through partner platforms like Toptracer, GolfTrak, and PinSeeker. Each contest may include additional rules (“Contest Rules”) which form part of these Terms.

We reserve the right to limit:

The number of contests you may enter in a certain timeframe

The number of entries per contest or device

We may suspend or terminate your participation if you are found to be ineligible, violate the Contest Rules, or engage in prohibited behavior. In such cases, we may issue a credit or donation refund at our discretion.

4. Donations and Entry Fees

Entering a contest requires a fee. The majority of profit from each fee supports the selected nonprofit, and a portion is retained to support platform operations.

Donations are generally non-refundable. If a contest is canceled or a technical issue occurs, you may contact support@chipin.golf to request a refund or credit. We will evaluate such requests in good faith.

By entering payment information, you confirm:

You are authorized to use the payment method

The information is accurate

You authorize us to charge the method for entry or other Services

5. Alerts and Notifications

You may receive system notifications, account alerts, or communications based on your preferences. Alerts may be sent by email, mobile notifications, or other means. We cannot guarantee delivery or timeliness of such alerts.

6. Prohibited Conduct

You agree not to:

Use the Services for illegal or fraudulent purposes
Impersonate others or provide false information
Attempt to circumvent contest limits, scoring systems, or platform features
Interfere with contests or other users
Reverse engineer or reproduce the platform without permission
Violate any contest rules or assist others in doing so
Violations may result in immediate suspension or termination of your access.

7. Third-Party Platforms and Links

Our contests are delivered through partner platforms like Toptracer and PinSeeker. These third parties have their own terms and policies. We are not responsible for their content, data handling, or availability.

8. User Submissions

By submitting content such as scores, usernames, or photos, you grant Benevolent Impact LLC a royalty-free license to use, share, modify, and display that content for platform-related purposes, including marketing and promotions.

We may also use your name or likeness in relation to sponsored content without additional compensation.

9. Intellectual Property

All content, software, designs, and materials in the Services are the property of Benevolent Impact LLC or its licensors. Unauthorized use is prohibited. You may not copy, modify, or distribute materials without written permission.

10. Indemnification

You agree to indemnify and hold harmless Benevolent Impact LLC, its officers, employees, and partners from any claims or liabilities resulting from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Disclaimer of Warranties

The Services are provided as is, without warranties of any kind. We do not guarantee uninterrupted access, accuracy of contest results, or protection from security threats. Your use of the Services is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Benevolent Impact LLC shall not be liable for any indirect, incidental, or consequential damages. Total liability for any claims shall not exceed $500.

13. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, to be held in [Insert State/County]. You waive your right to a trial by jury and to participate in class actions. If any part of this section is found unenforceable, the remainder shall still apply.

14. Modifications

We may update these Terms at any time. Updates will be posted on the website. Continued use of the Services after updates constitutes acceptance. If you do not agree to future changes, you must discontinue use.

15. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms or contest rules.

16. General Terms

These Terms, including the Privacy Policy and any posted contest rules, are the entire agreement between you and Benevolent Impact LLC. If any provision is held invalid, the remaining provisions remain in full effect.

17. Eligible Charitable Organizations

All donations made through the Chip In platform must be directed to organizations that are recognized by the Internal Revenue Service as tax-exempt entities under Section 501(c)(3) of the Internal Revenue Code. By participating in any fundraising activity on this platform, users agree that funds will only be distributed to verified 501(c)(3) organizations in good standing. Chip In reserves the right to request and review documentation to confirm the tax-exempt status of any organization and to withhold, redirect, or refund donations if the intended recipient does not meet this eligibility requirement.
